CALLYS Cosmetics SA commits itself to respect the confidentiality of the personal data mentioned by the customers during their order on the present website and to treat them within the limits imposed by the law.
At the time of the first registration via the present website, the customer has the right to refuse the sending of invitation emails or commercial communication by CALLYS Cosmetics SA. This possibility remains in force at any time.

Orders
The customer places an order via this website, and by the button "add to shopping cart" he adds the selected product to his shopping cart. He can continue his selection of articles, modify his shopping cart or complete his order and pay for the selection of products at any time.
Any order made on the present site by validating the shopping cart commits the customer to purchase the selected products according to the present general sales conditions. Order Confirmation
Once the order is validated and paid, the customer receives an order confirmation by email.
The data recorded by CALLYS Cosmetics SA constitutes an irrefutable proof of the order or the transaction carried out. All data recorded by the financial system constitutes irrefutable proof of the financial transactions.
In the event of an a posteriori refusal of the method of payment, CALLYS Cosmetics SA reserves the right to refuse or cancel the delivery, at its discretion, of any order placed on the present website as long as the payment is not settled.
Moreover, CALLYS Cosmetics SA reserves the right to sell the products to other customers able to pay the order if the pending payment is not settled in time (in case of tight stocks for example).


Prices
The prices payable for the products are those displayed on the present site on the date of the order, including VAT in Switzerland, but excluding delivery costs.
Delivery costs are charged in addition to the products ordered. These are visible at the time of the summary of the shopping cart. They are calculated according to the locality of the customer at the time of the order, which must be requested.
CALLYS Cosmetics SA reserves the right to modify at any time the prices and other charges mentioned on this site.


Representation of the products
CALLYS Cosmetics SA undertakes to match as closely as possible the photographs of the products as they are represented on the present site with those of reality. However, depending on the way the product is presented on the Internet, the representation of the product can potentially differ from reality. We have done our best to display as clearly as possible the colors and images of our products that appear on our store. We cannot guarantee that the display of colors by your computer screen will be accurate and true to reality.


Secure payment
All payments are made by credit card (Visa, Mastercard, Postfinance, American Express) or by Paypal or ApplePay account.
The order will be considered effective after confirmation of the agreement of the banking payment centers.
In accordance with the regulations in force, and to ensure the security and confidentiality of their information, CALLYS Cosmetics SA does not memorize the banking data of its customers. It is therefore up to the customer to save and print his payment certificate if he wishes to keep the payment details of his order. The credit card data is encrypted in order to protect the customer.


Delivery
The shipment of products ordered via this website is ensured by CALLYS Cosmetics SA.
The delivery costs are calculated at the end of the order according to the shopping cart, the weight, the volume and the rates of the carrier in charge of the delivery. They are charged to the customer unless special promotion specified by the seller himself.
As of the order and the confirmation of payment, the delivery times, as an indication, are from 2 to 3 working days, but can go up to 8 working days in very rare cases.
No delivery is made on Saturdays, Sundays or official holidays. If you are absent at the time of delivery, the deliveryman will leave a notice of collection in the letterbox. You must then pick up the delivery at the corresponding post office.

The benefit and risk of the delivery of the order is transferred to the buyer at the time of shipment from the premises of Callys Cosmetics SA.


Verification of the goods and return
It is the customer's responsibility to check the quantity and condition of the goods as soon as the products are delivered.
In case of error (damaged or missing product), the customer must inform CALLYS Cosmetics SA within seven days at the address mentioned below and in point 1 of the present general sales conditions. CALLYS Cosmetics SA will replace the missing or damaged product if the error is confirmed by its own services.
The products of CALLYS Cosmetics SA cannot be returned or reimbursed as long as they correspond in all respects to the order form and that they do not present any defect that could be charged to CALLYS Cosmetics SA.
The only returns likely to be accepted by the company are those where the products present a production defect. If this is the case, the products must be returned as received in their original packaging accompanied by a proof of order to the following address:

Warranty
Without limiting the scope of these Terms and Conditions, no claim whatsoever for delivered products, non-delivery of products or otherwise may exceed the amount of the purchase price of the products that gave rise to a claim for damages. In no event shall Callys Cosmetics SA be liable for any indirect, incidental or consequential damages of any kind (even if the possibility of such damages was known or could have been known by Callys Cosmetics SA) arising in connection with its products, their use, their sale or this website.


Force majeure
CALLYS Cosmetics SA will do everything in its power to fulfill its obligations but will not be held responsible in any way for cases of force majeure or fortuitous events. Thus, any delays or lack of delivery resulting from circumstances beyond its control, in particular in the event of strikes, wars, epidemics, confinement, natural disasters or any other circumstances that prevent the smooth running of production, transport or delivery of products cannot be charged to the seller. In addition to the cases usually retained by the jurisprudence, are established expressly as force majeure or fortuitous events the blocking of the means of transport or supplies, earthquakes, fires, storms, floods, lightning, the stoppage of the telecommunication networks or difficulties specific to the telecommunication networks external to the customers.
In case of delay, CALLYS Cosmetics SA will fulfill its obligations as soon as possible and reserves the right to distribute the remaining stocks of products among its customers in an equitable manner.


Partial non-validation
If one or several stipulations of the present general conditions are recognized as invalid or declared as such in application of a law, a regulation or following a definitive decision of a competent jurisdiction, the other stipulations keep all their force and their scope.


Applicable jurisdiction
The present general terms and conditions of sale as well as all sales where they are applicable are subject to Swiss law. Any dispute arising from or in connection with these terms and conditions shall be governed by Swiss law.
The exclusive place of jurisdiction is Fribourg, Switzerland.
